1. Acceptance of Terms

By accessing or using DawBets (available at dawbets.com and through our mobile web app), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use DawBets.

These terms apply to all visitors, registered users, and subscribers. We may update these terms from time to time, and your continued use of DawBets after changes are posted constitutes acceptance of the updated terms.

2. Description of Service

DawBets is a sports betting analytics platform. We provide:

• Real-time comparison of odds across legal US sportsbooks
• Positive expected value (+EV) bet identification using mathematical models
• Fair price calculations derived from market consensus
• Suggested wager sizing based on Kelly criterion
• Odds browsing and cross-book comparison tools
• Bet tracking and performance analytics
• Parlay and boost analysis tools

DawBets is NOT a sportsbook. We do not accept bets, process wagers, hold funds, or facilitate any gambling transactions. All betting activity takes place on third-party sportsbook platforms that you access independently.

3. Eligibility

You must be at least 21 years of age to use DawBets. By creating an account or using the service, you represent and warrant that you are 21 or older.

You are solely responsible for determining whether sports betting is legal in your jurisdiction. DawBets does not represent that sports betting is legal in any particular location, and the availability of our analytics tools does not constitute a statement about the legality of sports betting where you are located.

4. Account Registration

To access certain features, you must create an account. When you register, you agree to:

• Provide accurate and complete information
• Maintain the security of your login credentials
• Notify us promptly of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You may delete your account at any time through the Settings page. Account deletion is permanent and cannot be undone.

5. Subscription and Billing

DawBets offers three tiers of service:

• Free -- Basic access to odds browsing and limited analytics
• Plus -- $19/month (or annual equivalent), includes full EV feed access and enhanced tools
• Pro -- $30/month (or annual equivalent), includes all features plus advanced analytics

Free Trial

New users receive a 7-day Pro trial at no cost and with no credit card required. When the trial ends, your account reverts to the Free tier unless you subscribe.

Billing and Payments

All payments are processed securely through Stripe. By subscribing, you authorize recurring charges at the applicable rate until you cancel. Prices are listed in US dollars and may be updated with notice.

Cancellation

You may cancel your subscription at any time through the Settings page or Stripe billing portal. Cancellation takes effect at the end of your current billing period -- you retain access to paid features until then. We do not offer prorated refunds for partial billing periods.

Downgrade and Data Preservation

If you downgrade to a lower tier (or your subscription lapses), your data is preserved but features restricted to your current tier become inaccessible. Your data remains intact and becomes accessible again if you re-subscribe to the appropriate tier.

6. Intellectual Property

DawBets and its operators own all rights, title, and interest in the platform, including but not limited to:

• The DawBets name, logo, and branding
• Our proprietary algorithms, mathematical models, and analysis methods
• Website design, code, and user interface
• Curated content, editorial material, and educational resources

You may not copy, modify, distribute, sell, or create derivative works based on DawBets content or technology without our prior written consent. Odds data displayed on DawBets is sourced from third-party providers and remains the property of its respective owners.

7. Acceptable Use

You agree not to:

• Use automated tools, bots, or scrapers to extract data from DawBets
• Resell, redistribute, or commercially exploit DawBets data or analysis
• Attempt to circumvent subscription restrictions or access controls
• Share your account credentials with others or operate multiple free accounts
• Use DawBets for any unlawful purpose
• Interfere with or disrupt the service or its infrastructure

8. Disclaimers

DawBets is provided "as is" and "as available" without warranties of any kind, whether express or implied.

Not Gambling or Financial Advice

DawBets provides data, mathematical analysis, and informational tools. Nothing on DawBets constitutes gambling advice, financial advice, or a recommendation to place any specific bet. All betting decisions are yours alone.

No Guarantee of Accuracy

Odds data is sourced from third-party providers and may contain errors, delays, or inaccuracies. Our expected value calculations, fair prices, and wager suggestions are based on mathematical models that involve assumptions and simplifications. We do not guarantee that any data, calculation, or recommendation is accurate, complete, or current.

No Guarantee of Profit

Positive expected value (+EV) is a mathematical concept describing long-run statistical advantage. It does not guarantee profit on any individual bet or over any time period. Past performance of identified +EV opportunities does not predict future results. Sports betting involves substantial risk of loss.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• DawBets and its operators, employees, and affiliates shall not be liable for any losses you incur from sports betting, regardless of whether those bets were informed by DawBets data or analysis.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
• Our total aggregate liability for any claims related to the service shall not exceed the amount you paid to DawBets in the 12 months preceding the claim.
• We are not liable for service interruptions, data loss, or errors in third-party data displayed on DawBets.

You acknowledge that sports betting carries inherent financial risk. You are solely responsible for your betting decisions, wager amounts, and any resulting gains or losses.

10. Responsible Gambling

DawBets is committed to responsible gambling. While we are an analytics tool and not a sportsbook, we recognize that our users engage in sports betting. We encourage you to:

• Set a budget for your betting activity and stick to it
• Never bet more than you can afford to lose
• Treat sports betting as entertainment, not a source of income
• Take breaks and be mindful of how much time and money you spend betting
• Seek help if betting is negatively affecting your life

11. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Abuse of the platform (scraping, unauthorized redistribution, etc.)
• Fraudulent activity or misrepresentation
• Non-payment of subscription fees

You may terminate your account at any time by deleting it through the Settings page. If you have an active subscription, cancellation and deletion are separate actions -- canceling your subscription stops future charges, while deleting your account removes your data permanently.

12. Third-Party Services

DawBets integrates with and links to third-party services, including sportsbooks, payment processors (Stripe), and data providers. We are not responsible for the practices, content, or availability of these third-party services. Your use of third-party sportsbooks is governed by their respective terms of service and privacy policies.

Deep links to sportsbook apps or websites are provided for convenience only. DawBets does not endorse any particular sportsbook and is not responsible for the terms, odds, or outcomes offered by those platforms.

13. Changes to Terms

We may revise these Terms of Service at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, notify you via email or an in-app notice. Your continued use of DawBets after changes take effect constitutes your acceptance of the revised terms.

We encourage you to review these terms periodically.

14. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from or related to these terms or your use of DawBets shall be resolved in the state or federal courts located in Delaware.

15. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
